EVEN BEFORE THE COURT SHOWDOWN: TRENCH WARFARE
---------------------------------------------------------------
By Juan Montoya
The politiquera on the other side of the line was breathless with indignation.
"Andan dando sobresitos cerrados con una carta de Aurora De la Garza asustando a la gente (Begum's people are giving out closed envelopes with Aurora De la Garza's name scaring people) and telling them they'll get thrown in jail if they don't go to court tomorrow," she accused.
She is a well known Ernie Hernandez supporter who was active in getting out the mail-in and early walk-in vote for her daughter Erin Hernandez Garcia's campaign to finish the unexpired term of the late Tony Torres.
Even after I explained to her that under judicial rule, both sides of a contest are authorized to issue subpoenas compelling witnesses to appear and testify, she was adamant that Yolanda Begum's supporters and process servers were doing something illegal.
And I told her that to interfere with the process serving or to counsel people who had been served not to appear could be interpreted as obstruction of justice.
In the last election contest between Ernie Hernandez and Ruben Peña for Cameron County Pct. 2 commissioner, witnesses say that some of those people cited to appear mysteriously left town and the constables could not find their whereabouts. That helped to doom Peña's contesting the election through what the court recognized as obvious voter fraud Only 49 votes separated the winner from the loser in that contest. Peña was able to disqualify 42 votes, but deadlines to print ballots and other time considerations stymied his quest.
On the flip side, some of Begum's supporter called to say that politiqueras associated with Hernandez had gone to the Brownsville Housing Authority's 14-story High-Rise on St. Charles to urge those elderly and disabled voters who were cited to appear not to go the the Tuesday 10 a.m. trial.
"If you go over there you can get their picture," they said.
The fact of the matter is that Begum's lawyers issued some 70 subpoenas after documenting questionable ballots cast by the elderly and the mentally-incapacitated voters in the July 31 runoff for the position after Begum prevailed over Hernandez, her closest rival, by some 500 votes in the May 29 primary.
The discrepancies and potential illegalities that were unearthed during the runoff elections was what triggered the court contest. Begum's supporters and legal reps charged in their lawsuit that they would prove that Hernandez's cadre of politiqueros and politiqueras literally kidnapped the elderly and mentally-incapacitated voters and held them captive in campaign propaganda-laden vans and then coerced them to vote for Erin Hernandez.
Pictuers provided to local bloggers seem to bear out their allegations. And a police report filed by local political mover Zeke Silva indicated that some proof existed that the Hernandez camp was taking elderly without their consent to the voting polls.
They also said that they would prove that numerous state election code laws were violated by the Hernandez camp in soliciting, manipulating and carrying off mail-in ballots that they filled out for some elderly and illiterate voters. They vowed that they would present the evidence in court for the world to see.
That, in turn, set off the Hernandez and the politiqueras complaining that Begum was crying "sour grapes" with her complaints and would not have filed the lawsuit if she had won. Hernandez was declared the winner by 152 votes.
Now, as the court showdown looms on Tuesday at 10 a.m. in the 357th District Court, the hidden war will become a forum for Cameron County democracy for the public to see warts and all.

NEW LOGO OF COUNTY JUSTICE: "HALL OF YA 'STAS"
---------------------------------------------------------------
By Juan Montoya
Do you remember the hilarious skit in the 1970s by Richard Pryor called "Justice"
It's a joke about black men in prison. Pryor said: "You go down there looking for justice; that's what you find: just us."

Now some of my lawyer friends are saying that as a result of the ongoing investigation of judicial corruption triggered by the convictions of former 404th District Judge Abel Limas , former state representative Jim Solis, Port Isabel attorney Ray Marchan and the indictment of Cameron County District Attorney Armando Villalobos, the Cameron County Judicial wing has earned itself a new name.

"It's not the Hall of Justice anymore," one of them quipped. "It's now the Hall of 'Ya 'Stas," (or there you are as if handing someone money).

That sense of humor just goes to show that despite the slim pickings at the legal profession nowadays, there is some mean wit still being generated on the lawyers' lair on Harrison Street.

From what is emerging from the racketeering investigation it seems that there were greenbacks changing hands from the lobby of the judicial wing to Villalobos' bunker on the second floor and all the way to the top where District Clerk Aurora De la Garza's reigns over her domain.

"Everyone knew that you needed to grease some palms to get the wheels of justice turning," said another. "That's where the phrase 'Ya 'Stas' comes from. When an offer was made, money changed hands from one player to another and you'd say 'Ya 'Stas.' Then, they'd turn to the client and tell him 'Ya 'Stas.''

"There was 'Ya 'Stas' for everyone."

One can imagine the feds leading a lawyer away and him emulating Pryor with "Is it Something I Said?"

This is the spot where the Brownsville Latin Jazz Festival has hewn out for itself and the promoters of the Freddie Gomez concert said they were pleased with the turnout.
"George Ramirez just got here and told us that we have outdone ourselves," said Timo Ruedas, the president of the Brownsville chapter of the South Texas Conjunto Association.
The festivities kicked off with the grandsons of Freddie Gomez (El Ciclon del Valle) playing their modern music predilection of blues and electric modern music before the conjunto groups like Los Halcones, Accordion Whiz-Kid Peter Anzaldua and Los Hometown Boys came on to play the crowd's favorites.
"The Gomez grandkids carry it in the blood," Ruedas asserted.
Various stands sold beer and boatana to the appreciative crowd. And as if to show that locals aren't shy about dancing, the dancing space in front of the stage filled rapidly with couples dancing nortenas, polkas and some more esoteric north Mexico dances.
Downtown may be dead, but the culture that was here when buildings like El Jardin Hotel and the Capitol Theater were erected remains vibrant and taconeando.

MAYOR MARTINEZ BUMPER STICKER: "YO ME EMPINO POR UTB"
---------------------------------------------------------------
By Juan Montoya
Undaunted that his entreaties to the UT System to move its new campus downtown seem to have fallen on deaf ears, Hizzoner Da Mayor Tony Martinez has launched a media blitz (with our dollars, of course) to offer the voracious UT Regents a palatable "package" so they can stay put.
In a three-quarter paid ad in Sunday's Brownsville Herald, the city is asking property owners within the boundary of Boca Chica Boulevard, the U.S. border and the Brownsville/South Padre Island International Airport to submit a letter of interest to the city (or perhaps United Brownsville?) that they be included in the Request For Proposals (RFP) to be presented to the UT System to see if maybe, just maybe, the Regents will deign to stay downtown instead of moving on up north as most new enterprises are wont to do in Browntown.
Da Mayor, of course, admonishes the property owners that "all properties considered will be at fair market value with appraisal confirmation and in accordance with the Texas Government Code."
So Realtors, real-estate investors and property owners, Da Mayor wants you to jump on board with him and offer the UT System â" the third-richest institution of higher education in the United States â" your property at no profit. Real estate investors locally will tell you that the market has not only hit bottom, but has gone below ground level. So the mayor's advice amounts to "sell low" and take a loss in your investment in the interest of helping out the poor UT System so that they won't go somewhere else."
About the only thing missing from this appeal is a phony deadline for action that is the hallmark of every and all communications that the UT System, through its UTB reps like Juiliet Garcia and Michael Putegnat, have made to the Texas Southmost College trustees and local residents.
At least it wasn't the voracious offer made by UTB's Juliet Garcia when she offered local residents the opportunity to offer a new "partnership" to TSC district taxpayers with the caveat that the UT System would only agree if they turned over the entire assets of the community college â" real estate, buildings, bank deposits, future dreams, etc. â" as a "gift" to the Regents.
But she wasn't totally greedy. The "partnership" would last only as long as it took TSC taxpayers to pay the $100 million in construction bonds and interest. After that, the UT System would consider the partnership finished and the voracious Regents would walk away from the carcass that would have been TSC.
Someone at the Herald either has a wicked sense of humor or involuntarily placed the promo for the Herald comics at the bottom of Hizzonor's ad.
"Ha! Ha! Ha! Hilarious," reads the text at the bottom of the page. We agree.
